Objection to Development Standard CCLEP2022

Use this form for objection to a development standard contained within a gazetted environmental planning instrument under the provisions of a Standard Instrument Local Environmental Plan. An objection statement is required if your development does not comply with a particular development standard applicable to the proposal. There is no automatic right to a variation and the onus is on the applicant to justify the departure from the development standard. It is only in justified circumstances that Council may vary a development standard.

Onsite Sewage Management System Application for Plumbing and Drainage Inspection. All plumbing and drainage works must be in accordance with the Plumbing and Drainage Act 2011. This includes provision of a Notice of Work, Certificate of Compliance and a Sewer Service Diagram by the licensed plumber within the required time periods. Plumbing works are required to be inspected by Council. Principle Certifiers are not authorised to inspect plumbing works.

Part B - Application Detail and Owners Consent

Part B – Application Detail and Owner(s) consent is to accompany all applications submitted via the NSW Planning Portal, including Development Applications, Complying Development Certificate, Construction Certificate and Subdivision Certificate applications. This form must be completed and signed by all owners of the land on which the application for development is proposed. 

 

Written consent of the owner of land if a development application is made by a person other than the owner is required pursuant to the Environmental Planning and Assessment Regulation 2021. Further details on landowner consent requirements are provided below: 

1. Company

If the owner is a company, the owner’s consent must be signed by one company director and one company secretary, or 2 company directors. Where the company has one director or secretary, only one signature is required. The applicant must provide the names and positions of those signing the consent and a current company extract from the Australian Securities and Investments Commission  (asic.gov.au) dated the day of lodgement or the day before.

2. Strata title

If the property is a unit under strata title, then in addition to the consent of the owner(s) of the unit, owner’s consent from the owners corporation must be provided if any works or proposed use will affect common property. The owner’s consent from the owners corporation must be signed in line with section 273 of the Strata Schemes Management Act 2015 (NSW) by way of the seal of the owners corporation being affixed in the presence of: 

  • where the owners corporation has only one owner, that owner or the strata managing agent  
  • where the owners corporation has only two owners, both those owners or the strata managing agent
  • where the owners corporation has more than two owners, either of the following:
  • two owners as determined by the owners corporation
  • the secretary of the owners corporation and any other member of the strata committee
  • the strata managing agent.

The owners corporation must also provide a copy of the minutes of the general meeting showing the special resolution that authorises the change to common property has been passed, or a letter on strata management letterhead stating the requirements of section 108 of the Strata Schemes Management Act 2015 (NSW) have been met.

3. Signing on owner’s behalf

If you’re signing on the owner's behalf as the owner's representative, you must state the nature of your legal authority and attach documentary evidence of your authority – a full copy is required. Depending on the nature of your authority, the following evidence may be accepted:

  • power of attorney
  • trust deed
  • probate
  • letters of administration
  • delegation schedule
  • letter on company owner’s letterhead confirming your authority.

4. New owners

If the property has recently been sold, evidence of the new owner being the registered owner must be provided with a copy of the certificate of title.

Private Pumping Station Non-Residential - Application

Private pumping stations are installed by property owners in a non-residential site, in properties where Council’s reticulated sewerage system does not service the property and/or the sewage from the property cannot gravity flow to Council’s sewerage system. An application to install a private pumping station is required under section 68, Part C6 of the Local Government Act 1993. Council’s approval of the installation will provide conditions that include, but are not limited to the following:

  • odour control, to minimise septicity of the discharge

  • maximum volume discharged

  • construction details

Council will routinely inspect the private pumping station to ensure compliance with the approval in the following areas:

  • instantaneous flow rate to the seweragesystem (Litres/second)

  • acceptance limits in relation to hydrogensulphide gas generation

  • detection of offensive odours

  • the condition of the installation

Temporary and Mobile Food Business Notification

Any temporary or mobile food business must notify Central Coast Council if it intends to conduct business at any event within the Central Coast local government area. A notification fee is not charged, however, where an inspection is conducted, an inspection fee may be invoiced following the event.

You are required to:

  1. Submit the Notification Form. Note, no fee is required until you have been inspected.
  2. Comply with the requirements of the NSW Food Act 2003, NSW Food Regulation 2015, Australian New Zealand Food Standards Code and relevant guidelines,
  3. Display the Council Approval to Operate in your stall at the event, and
  4. Pay any inspection fees that may be invoiced after the event.

Please note, if your food business is resident in a Council area other than Central Coast, a copy of an inspection report, i.e. the FPAR report dated within the past 12 months is required to be submitted with the notification form. Not-for-profit fundraising organisations are still required to submit a Notification Form.

An important way town water can be protected is to prevent the backflow of water from premises considered to be a potential risk of cross contaminating town water with polluted water. Town water in these circumstances can be protected by installing a backflow prevention device. Council require a backflow prevention device be installed by an accredited licensed plumber at the property boundary and registered with Council. Lodgement for all new water supply require a backflow prevention Application and payable fee is required.
