Access to information

Central Coast Council is committed to open, accountable and transparent government through the timely release of Council held information that is of interest to our community.

Under the Government Information (Public Access) Act 2009 (NSW) (GIPA Act), you are entitled to see a lot of information that Council holds in records. The GIPA Act provides four ways you can access information from Council and other NSW government agencies.

Open Access (Mandatory proactive release)

This covers information that is routinely available on our website, free of charge. It includes Council meetings and agendas, Annual Reports, Council policies and procedures and information about development applications, local approvals and orders. You can search for these documents in the News and Publications section of the website.

Authorised proactive release

Council proactively releases other information free of charge, where there is no overriding public interest against doing so. This may include reports about particular issues, plans and initiatives of Council.

Council’s Chief Executive Officer (CEO) determines whether information held by Council is proactively released. All commercially sensitive information must be redacted from documents that are proactively released, plus personal identifying information to ensure Council complies with the Privacy and Personal Information Act 1998.

Documents relating to the Wyong Employment Zone (WEZ) (including the Warnervale Airport/Central Coast Airport) that have been proactively released can be viewed here.

Information proactively released by Council will be made available in the most appropriate manner. Council will endeavour to make all proactively released information available on Council’s website. However, if Council does not have the permission of the Copyright holder this will not be possible. In those circumstances, the document will be able to be viewed at the Gosford or Wyong Council offices.

Informal release

You can informally apply for other information from Council too. Information will be informally released if there is no overriding public interest against release of the information. For example, you may be entitled to information about yourself, but not someone else.

Informal Information Access Request Form includes guidelines to help you in lodging your request. There is no fee for the request, however charges may apply for copying of documents.

You also need to be aware of copyright restrictions as this can impact Council’s ability to provide access to certain information. There may be circumstances where Council cannot provide copies of information unless it receives the copyright owner’s written consent. The form, Consent to Council – Copyright, includes information on how to locate the copyright owner. Please have the copyright owner complete the form and provide it with your request.

Print the form and submit via email, or in person at one of Council’s offices.

Formal release

Council makes formal decisions on these kinds of applications. Charges and time limits apply and Council decisions can be appealed to the Information Commissioner and/or to the NSW Civil and Administrative Tribunal (NCAT).

Formal Information Access Request Form includes guidelines to help you in lodging your request. There is a $30 application fee for the request and this fee covers two hours of processing time. After the two hours the processing fee is $30 per hour. In certain circumstances Council will apply a 50% reduction to the processing charges (not the application fee). For example, in cases where the applicant is a Concession card holder, is suffering from financial hardship or the application is on behalf of a not for profit organisation.

This records details about information that has already been released in response to a formal information access request and may be of interest to other members of the public. Council updates the Disclosure Log of Access Applications on a regular basis and in accordance with the Government Information (Public Access) Act 2009 (NSW) (GIPA Act).

Pecuniary Interest Register

Please contact Council’s Governance Team to organise a time to inspect the register in person at either the Gosford or Wyong Administration offices.
